By using DustPermit (dustpermit.com), you agree to these terms. Please read them carefully.

Services

DustPermit provides dust permit filing services with Maricopa County MCAQD and permit pipeline intelligence on behalf of our customers. We are not a government agency and are not affiliated with Maricopa County.

Your Responsibilities

You must provide accurate project information (location, acreage, activity type). Inaccurate information that causes a permit deficiency is not covered by our guarantee.
You are responsible for complying with your approved Dust Control Plan on-site once the permit is issued.
You must notify us of material project changes (scope, location, timeline) that would affect permit terms.

Payment

Filing service fees are due at the time of order. County fees are invoiced separately at exact cost — we charge you the precise amount MCAQD charges us, with zero markup. All fees are stated in USD.

Subscriptions (Annual Filing, Pipeline Intel, Full Stack) are billed annually. Cancellations take effect at the end of the current billing period — no prorated refunds.

Violation Guarantee

If a permit we filed causes a dust control violation:

We will remediate the filing error at no cost
We will cover the resulting fine up to $5,000 per incident

The guarantee does not apply when:

The violation results from on-site non-compliance with an approved Dust Control Plan
You provided inaccurate project information
The violation results from project changes you did not notify us of
The permit was filed under a non-filing plan (one-off) and a renewal was missed without a reminder opt-in

Pipeline Intel

Pipeline Intel data is sourced from public MCAQD permit records and is provided for informational purposes. We do not guarantee real-time accuracy — permit data may lag official records by up to 24 hours. This data is for your internal business use only and may not be resold or redistributed.

Intellectual Property

DustPermit and its content, trademarks, and software are owned by DustPermit LLC. You may not copy, modify, or redistribute any part of the service without written permission.

Limitation of Liability

To the maximum extent permitted by law, DustPermit's total liability for any claim arising from use of the service is limited to the amount you paid us in the 90 days preceding the claim. We are not liable for indirect, incidental, or consequential damages.

Governing Law

These terms are governed by the laws of the State of Arizona. Any disputes will be resolved in Maricopa County, Arizona.

Changes to Terms

We may update these terms. We'll notify active customers by email 30 days before material changes take effect. Continued use after that date constitutes acceptance.
